BOARD MEMBER QUALIFICATIONS
(Governing Board Membership)

To qualify for election to the Governing Board, a person must meet the following criteria:

  1. Be a registered voter in the state of Arizona.
  2. Have been a resident of the District for at least one (1) year immediately preceding the election date.

Employment Restrictions

  • No employee of the District or any person providing certificated or support services to the District through a third-party contractor may serve on the Governing Board. This restriction extends to the spouses of such employees.

Dual Governing Board Membership

  • A Governing Board member cannot serve simultaneously on the board of another school district. However, a member may run for election to another board if they are in the last year of their term.

Five-Member Board Same Household Limitation
In districts with five (5) members on the Governing Board, the following restrictions apply to individuals from the same household or immediate family:

  • They cannot serve simultaneously on the Governing Board.
  • They are ineligible for nomination or election to the Governing Board unless one member is serving in their final year of office.
  • They cannot be simultaneous candidates for the Governing Board.

A qualified elector residing in the District may bring an action in Superior Court to enforce these restrictions.

Definitions
For this policy, "immediate family" and "household of residence" are defined by A.R.S. 15-421.
