BOARD MEMBER CONFLICT OF INTEREST
Voting Restrictions
A Governing Board member is eligible to vote on most matters before the Board. However, it is prohibited for a member to vote on any issue specifically relating to the appointment, employment, or compensation of the member or any individual who qualifies as a dependent of the member, as defined in A.R.S. 43-1001.
Employment Limitation
No dependent of a Governing Board member, as defined in A.R.S. 43-1001, may be employed by the District without the consent of the Board. Additionally, an employee of the District or their spouse may not serve as a Governing Board member. The District may employ former Governing Board members within two years of their service, provided the position involves direct services to students, though the District may extend this restriction beyond two years, if necessary.
Conflict of Interest
Any Board member or employee with a substantial interest in a contract, purchase, or service involving the District must disclose that interest in the District's official records and abstain from participating in any discussions or decisions regarding the matter. This includes any decision or action that affects the employee or relative’s interest. Abstaining from participation means not engaging in any aspect of the decision-making process, including making recommendations or providing advice.
Purchases from Governing Board Members for Districts with 3,000 or More Students
In Districts with 3,000 or more students, any purchase of services from Governing Board members must follow public competitive bidding procedures, regardless of the transaction amount. Purchases of supplies, materials, and equipment are subject to the following limits:
- Individual transactions for supplies, materials, or equipment may not exceed $300.
- Total purchases within a 12-month period must not exceed $1,000.
- Purchases must comply with USFR guidelines for obtaining quotations.
- The Board must have approved or reconfirmed the policy allowing such purchases within the preceding 12 months.
Filing of Disclosures
The District shall maintain a publicly accessible file containing all conflict-of-interest disclosures, ensuring transparency in decision-making and compliance with state regulations.
