Section G - Government

BOARD MEMBER INSURANCE / LIABILITY

In accordance with state law, Governing Board members are protected from personal liability for actions taken in good faith within the scope of their authority during regular and special meetings. The District may provide additional protection by purchasing insurance or establishing a self-insurance program. This may cover direct payment of benefits, losses, or claims, including risk-management services, to address property loss or liability claims against the District or its employees and officers, provided they were acting within their official capacity.

The District will also secure general liability, property damage, workers' compensation insurance, and performance and payment bonds for construction projects.

Participation in Group Insurance Plans

Governing Board members and their dependents may participate in the health, accident, life, or disability insurance plans offered to District employees, provided that they cover the full cost of the premiums. Their participation must not result in any cost to the District.

Former Board members, their spouses, and dependents, as well as surviving spouses or dependents of former Board members, may continue to participate in District insurance plans under the following conditions:

  • The former Board member must have served at least four (4) consecutive years on the Board, must have been enrolled in the insurance plan during their term, and must cover the full cost of premiums.
  • Spouses and dependents may continue coverage if they pay the full premium cost.
  • Surviving spouses or dependents are eligible for continued coverage if the deceased Board member served four (4) consecutive years and was enrolled in the insurance plan during their term.
