SCHOOL ATTORNEY

The Governing Board may employ an attorney to represent the District, provided the county attorney grants consent. The specific purpose for which the attorney is engaged must be outlined in writing by the Board at the time of employment.

In situations where the Governing Board deems it advisable, it may employ legal counsel without the need for the county attorney’s consent.

The terms of compensation and the specific scope of work should be clearly determined at the time of hiring private counsel.

The Superintendent and the Board President will be designated as the official representatives who may confer with the attorney on behalf of the District. The District will not be held responsible for legal fees resulting from unauthorized consultations between individual Board members or staff and private counsel.

Copies of all written requests for legal opinions and any responses from private counsel shall be shared with all Board members by the Superintendent. Requests that necessitate significant research or substantial work by private counsel should, when feasible, be made in writing.
